ASAM Comments on Proposed Federal Anti-Kickback Statute Amendments

With close to two decades of experience in the profession, Dr. Sridhar Yaratha is a psychiatrist at Gateway Homes, a position he has held since 2009. In addition, Dr. Sridhar Yaratha is a member of several professional organizations, including the American Society of Addiction Medicine (ASAM), which advocates for improved addiction treatments.

The ASAM recently commented on proposed amendments to the Federal Anti-Kickback Statute, which would add new harbors under the law while also altering several others. They would also add exceptions to beneficiary inducements, which, the ASAM argues, would protect taxpayers and patients from potential fraud and other financial abuses.

While the ASAM agrees that laws should continue to ban patient-brokering tactics, it also claims that gift cards and cash should still be allowed for substance abuse treatments. The organization claims that the practice, known as contingency management, is one of the more effective psychosocial methods to help treat methamphetamine addiction.

The ASAM highlights several evidence-based studies that claim that monetary rewards could be used to promote positive behavior, such as abstinence, and eventually help with beating addiction.
